Welcome to The Rosé. These Terms of Service (“Terms”) apply to all purchases made through our website and any orders placed directly with us.

By placing an order with The Rosé, you agree to these Terms.

1. Products and Availability

All flowers and floral products are subject to seasonal and market availability.

As fresh flowers are natural products, variations in colour, size, shape, bloom stage and appearance are normal. The arrangement you receive may not be identical to the photographs displayed on our website.

We reserve the right to substitute flowers, foliage, wrapping materials or decorative elements where necessary due to availability.

Where substitutions are required, we will aim to maintain the overall:

  • colour palette;
  • style;
  • size;
  • aesthetic; and
  • value

of the arrangement originally ordered.

For significant substitutions that materially change the overall appearance of the arrangement, we may contact you before proceeding where reasonably practicable.

2. Product Images

Product images on our website are intended as a guide to the overall style and presentation of our arrangements.

Because flowers are natural and seasonal products, the exact flowers, shades, bloom sizes and arrangement may vary from the images shown.

Colours may also appear differently depending on lighting, photography and the screen or device used to view our website.

3. Flower Sizes

Where different bouquet sizes are offered, such as Small, Medium or Large, photographs may represent only one particular size unless otherwise stated.

The number of stems may vary depending on flower type, season, stem size and the overall design of the arrangement.

Our sizing is based primarily on the overall presentation, volume and value of the arrangement rather than a guaranteed number of stems, unless a specific stem count is stated in the product description.

4. Orders

Customers are responsible for ensuring that all information provided when placing an order is accurate, including:

  • recipient name;
  • delivery address;
  • recipient phone number;
  • requested delivery date;
  • card message; and
  • any delivery instructions.

Please check your order carefully before completing payment.

We reserve the right to decline or cancel an order if:

  • the requested flowers or products are unavailable;
  • the delivery address is outside our service area;
  • incorrect pricing or product information has been displayed;
  • we are unable to safely complete the delivery; or
  • circumstances outside our reasonable control prevent us from fulfilling the order.

If we cancel an order that has already been paid for, we will provide a refund of the amount paid for the cancelled item or order.

5. Pricing and Payment

All prices displayed on our website are in Australian Dollars (AUD).

Any applicable taxes or delivery charges will be displayed where relevant before the order is completed.

Full payment must be received before an order is prepared or delivered unless otherwise agreed in writing.

6. Delivery

We will make reasonable efforts to deliver your order on the requested delivery date.

Unless a specific delivery time has been expressly agreed with us, delivery dates do not guarantee delivery at an exact time.

Delivery times may be affected by factors outside our control, including:

  • traffic;
  • weather;
  • road closures;
  • vehicle issues;
  • building access;
  • recipient availability; and
  • unusually high order volumes.

A delivery is not considered late solely because it arrives at a different time of day than expected, provided it is delivered on the agreed delivery date, unless a specific delivery time was expressly confirmed by us.

7. Recipient Availability and Delivery Access

The customer is responsible for providing a complete and accurate delivery address and, where possible, a valid recipient phone number.

If no one is available to receive the flowers, we may, where we consider it reasonably safe and appropriate:

  • leave the flowers in a safe location;
  • leave them with reception, concierge or building management;
  • leave them with another authorised person; or
  • contact the recipient or purchaser to arrange another option.

Once flowers have been safely delivered to the address provided, we are not responsible for loss, theft, damage, deterioration or weather exposure occurring after delivery.

Where delivery cannot be completed because of:

  • an incorrect address;
  • incorrect contact details;
  • restricted building access;
  • the recipient refusing delivery; or
  • nobody being available and there being no safe place to leave the flowers,

a redelivery fee may apply.

Because fresh flowers are perishable, additional charges may also apply if the arrangement needs to be remade before redelivery.

8. Delivery Instructions

Any delivery instructions provided by the customer will be followed where reasonably practicable.

However, delivery instructions cannot always be guaranteed, particularly where they conflict with safety requirements, property access restrictions or circumstances outside our control.

9. Changes and Cancellations

If you need to change or cancel an order, please contact us as soon as possible.

For standard flower orders, cancellations made more than 24 hours before the scheduled delivery date may be eligible for a refund.

Orders cancelled within 24 hours of the scheduled delivery date may not be refundable where flowers have already been purchased, prepared or arranged.

Same-day orders cannot normally be cancelled once preparation has commenced.

Changes to delivery addresses, delivery dates, flower selections or card messages are subject to availability and cannot be guaranteed once preparation has commenced.

Nothing in this section limits any rights you may have under the Australian Consumer Law.

10. Change of Mind

Due to the fresh and perishable nature of our products, we do not normally provide refunds or exchanges simply because you have changed your mind.

This does not affect your rights under the Australian Consumer Law where a product or service does not meet applicable consumer guarantees.

11. Problems With Your Order

We take care in preparing every arrangement.

If you believe your flowers have arrived damaged, incorrect or in an unacceptable condition, please contact us as soon as reasonably possible after delivery.

To help us assess the issue, we may ask you to provide:

  • your order number;
  • a description of the issue; and
  • clear photographs of the flowers and packaging as received.

Depending on the circumstances and your rights under applicable law, an appropriate remedy may include a replacement, partial refund, full refund or another suitable resolution.

12. Fresh Flower Lifespan

Fresh flowers are perishable natural products and do not have a guaranteed lifespan unless we expressly state otherwise.

The lifespan of flowers varies depending on:

  • flower variety;
  • season;
  • temperature;
  • transportation;
  • water quality;
  • environment; and
  • how the flowers are cared for after delivery.

Some flowers may arrive partially closed so that they can continue to bloom after delivery.

For best results, recipients should follow the care instructions provided with the flowers.

Natural deterioration over time does not necessarily indicate that the flowers were defective at the time of delivery.

13. Custom and Bespoke Orders

Customised arrangements are created specifically according to the customer's requested style, colour palette, budget and available flowers.

Reference photographs supplied by customers are treated as inspiration only unless we expressly agree otherwise.

We cannot guarantee an exact reproduction of another arrangement because flower varieties, colours and availability may vary.

Once flowers or materials have been specifically purchased for a customised order, that order may not be refundable for change of mind.

14. Event and Large Orders

Weddings, events, corporate arrangements, opening stands and other large or customised orders may be subject to separate quotations, deposits, cancellation terms and payment conditions.

Where separate written terms are provided for an event or custom order, those terms will apply in addition to these Terms and will prevail to the extent of any inconsistency.

15. Greeting Card Messages

Customers are responsible for the content and accuracy of any greeting card message submitted with an order.

We reserve the right not to reproduce content that is unlawful, threatening, discriminatory, abusive or otherwise inappropriate.

16. Allergies, Pets and Safety

Some flowers and plants may cause allergic reactions or may be harmful if consumed by people or animals.

Customers and recipients are responsible for keeping flowers, plants, floral foam, preservatives, wrapping materials and decorative items away from children and pets where appropriate.

If you have specific allergy, pet-safety or plant-toxicity concerns, please contact us before ordering.

17. Website Information

We aim to ensure that product descriptions, prices and other information displayed on our website are accurate.

However, occasional errors may occur.

We reserve the right to correct errors, update information or cancel an affected order where a genuine pricing or product information error has occurred.

If an affected paid order is cancelled, the amount paid for that order will be refunded.

18. Intellectual Property

Unless otherwise stated, all content on The Rosé website, including:

  • photographs;
  • floral designs;
  • graphics;
  • branding;
  • logos;
  • written content; and
  • website materials

is owned by or licensed to The Rosé.

Content may not be copied, reproduced, commercially used or distributed without our prior written permission, except as permitted by law.

19. Third-Party Services

Our website may use third-party services for payment processing, website hosting, delivery, analytics or other business functions.

Your use of those services may also be subject to the relevant third party's terms and privacy policies.

20. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Our products and services come with consumer guarantees that apply automatically under Australian law.

Where there is a major failure with goods, customers may be entitled to choose a refund or replacement, together with any other remedies available under the Australian Consumer Law.

21. Limitation of Liability

To the maximum extent permitted by law, The Rosé will not be responsible for loss or damage caused by circumstances outside our reasonable control.

Nothing in these Terms is intended to exclude or restrict liability where doing so would be unlawful, including rights and remedies available under the Australian Consumer Law.

22. Privacy

Personal information provided when placing an order will be handled in accordance with our Privacy Policy and applicable privacy laws.

Customer and recipient contact information may be used where reasonably necessary to process, prepare and deliver an order.

23. Changes to These Terms

We may update these Terms from time to time.

The Terms applicable to an order will generally be those published on our website at the time the order is placed.

24. Governing Law

These Terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws of Australia.
